Terms of Use Agreement

This Terms of Use Agreement, along with the Privacy Policy, terms, conditions, and all policies published on the Tasweer platform, is established to protect the rights of both Tasweer Platform Company and the user who accesses the website—whether registered or unregistered—as well as the consumer benefiting from the content, with or without registration.

All terms, conditions, provisions, and any legal disputes are subject to the laws, regulations, and legislations enforced in the Kingdom of Saudi Arabia.

By being a user or consumer on the Tasweer platform, you agree to fully comply with all the terms stated in this agreement simply by using or accessing the platform or by registering for the service. Tasweer reserves the right to modify this agreement at any time, and such modifications become binding for all parties once they are announced on the website or through any other means.

Article One: Definitions

1. Tasweer Platform:
An electronic platform that allows users to create an account to publish their own content according to applicable regulations and laws. Its main headquarters is in Riyadh. It is referred to in this agreement as Tasweer Platform Company, we, us, the website, the platform, or the first party.

2. User:
A person who creates an account on the Tasweer platform for communication, browsing, content publishing, or creating an online shop as a service provider practicing e-commerce through Tasweer. Referred to as the user, the member, the practitioner, the service provider, or the second party.

3. Online Shop:
An electronic account that enables the user to display, sell, market, offer, advertise, or exchange information about a product or service.

Article Two: Terms of Use

As the second party in this agreement and a beneficiary of Tasweer’s services, you must comply with the following:

1. Avoid advertising or publishing any content that does not belong to the permitted categories on the platform, and review the advertising terms and prohibited items before posting.

2. Avoid breaching or circumventing any rules, laws, policies, or third-party rights.

3. Do not copy any listing from Tasweer and repost it elsewhere.

4. Do not use any illegal means to access listings or other users’ data, violate Tasweer’s policies, collect or harvest Tasweer data or user data for any purpose, or republish it.

5. Do not use the service if you are not legally eligible to enter into this agreement.

6. Do not manipulate product prices during sale or purchase or cause harm to consumers.

7. Do not include any false statements, misleading information, defamatory content, or anything that may deceive consumers directly or indirectly.

8. Do not engage in discussions that violate policies, public sovereignties, renowned personalities, or any unlawful discussions within Tasweer Information Technology.

9. Do not transfer your account or activity to other platforms while still representing Tasweer in any form.

10. Do not violate Tasweer’s intellectual property rights, including copyrights, trademarks, patents, publicity rights, databases, or any other IP rights owned or licensed by Tasweer.

11. Do not include logos or trademarks in your listings unless authorized to use them, and avoid posting imitated or infringing trademarks.

12. Do not violate human rights rules or engage in any form of human trafficking, and comply with regulations related to advertising labor services.

13. Comply with the commercial advertising regulations issued by the Ministry of Commerce and SASO.

14. Comply with permits issued by the National Center for Wildlife for items requiring such permits.

15. Do not collect or use users’ personal data or electronic communications for unauthorized purposes, nor disclose them to others without consent unless legally required.

16. Obtain a license from the Saudi Council of Engineers for any services regulated by the council.

17. Do not harm Tasweer’s reputation in any form, whether on the platform or on social media. Tasweer reserves the right to pursue compensation for all resulting damages.

18. Do not impersonate Tasweer, its representatives, or employees unless officially authorized.

19. The service may not be used by any non-human user, except automated systems belonging to:

    • Google

    • Facebook

    • X

Failure to comply grants Tasweer the right to suspend your membership, refer your violation to authorities, block your access, and add your phone number to the banned list without liability or prior notice. You may not object to this, and you agree not to return to the platform unless approved by Tasweer.

Article Three: Liability

1. Tasweer provides a service that allows users to display their products, services, and content according to the usage policy. Tasweer provides no guarantees and assumes no liability if users or consumers fail to comply.

2. Tasweer is not responsible for any risks, damages, consequences, or losses affecting sellers, buyers, or any party. Anyone harmed can visit the Contact Us page, describe the issue, and Tasweer will act accordingly without bearing responsibility.

3. By using Tasweer, you acknowledge that you are fully responsible for complying with all laws and regulations. You alone manage your purchases, deliveries, and disputes related to your content. You bear all consequences resulting from your content, and Tasweer is not responsible for any claims arising from your activities.

4. By using the platform, you authorize Tasweer to store your personal and non-personal data on its servers and review them when needed.

5. You acknowledge Tasweer’s right to monitor private messages when necessary to ensure compliance with this agreement, and its right to delete listings or manage images attached to listings when needed.

6. Any official announcements or instructions communicated by Tasweer through private messages, SMS, email, or platform notifications become binding once delivered.

7. If you violate Saudi laws or Tasweer’s policies, the platform has the right to seek compensation for all damages, losses, and legal fees.

8. Users agree that reviews—whether positive or negative—are public and reflect customer opinions. Tasweer is not responsible for their content and is not obligated to delete or modify them. Users bear full responsibility for the content of their reviews.

Article Four: Product Descriptions

1. You are fully responsible for the accuracy of your product or service descriptions; Tasweer does not guarantee the accuracy or content of listings. You bear full responsibility for any errors.

2. You acknowledge that Tasweer is not responsible for examining or verifying products or services listed for sale, nor for users’ or consumers’ activities.

3. Tasweer does not guarantee that product listings are free of illegal, deceptive, offensive, or harmful content.

4. Tasweer holds no responsibility for the performance of the services you provide.

5. Tasweer is not responsible for agreements or obligations between users and consumers, nor for confirming consumer identities or guaranteeing their behavior.

Article Five: Compensation

You agree to indemnify Tasweer and hold it harmless, along with its employees, administrators, managers, founders, affiliated companies, and related entities, against all claims, costs, damages, losses, legal fees, or any liabilities arising from your breach of this agreement, your violation of any Saudi law, or any third-party rights.

Article Six: Personal Files and Confidentiality

1. Users are obligated not to disclose private messages sent between them and other users.

2. It is strictly prohibited to store communication information such as emails, phone numbers, or attached materials to be used outside the platform in any way.

3. If you receive communication sent to you by mistake, you may not keep, copy, or republish it. You must notify us so we can take the necessary action.

4. Tasweer uses personal and non-personal user information for security and operational reasons or for notices, advertisements, and communication. The user agrees to grant Tasweer the right to use all information for purposes that improve and develop the user experience.

Article Seven: Intellectual Property

You agree that all content, including but not limited to: text, graphics, logos, icons, images, audio files, videos, downloads, data compilations, and software, are owned by Tasweer and protected under copyright and intellectual property laws. You may not violate any of these rights.

Article Eight: Prohibited Goods and Violations

You agree not to advertise or trade any of the following types of products or services, including but not limited to:

1. Illegal or unauthorized items

• Items prohibited by Saudi laws or by Shariah.

• Stolen items.

• Items that infringe copyrights, trademarks, patents, or trade secrets.

2. Hazardous or harmful goods

• Weapons or ammunition without proper permits.

• Drugs, narcotics, or any controlled substances.

• Explosives or hazardous chemicals.

3. Human trafficking or labor exploitation

• Any content involving human trafficking or violating human rights.

• Unlicensed services related to labor recruitment.

4. Unauthorized medical or health products

• Medicines, supplements, or medical devices not approved by SFDA.

• Medical consultations without a license.

5. Wildlife and environmental violations

• Selling animals or items requiring a permit without obtaining approval from the National Center for Wildlife.

6. Financial fraud and impersonation

• Any content involving fraud, deception, or impersonation of individuals, companies, or official entities.

Article Nine: Ads Violations

You agree to refrain from publishing any prohibited ads including:

1. Misleading, false, or deceptive ads.

2. Ads that contain offensive, immoral, or inappropriate content.

3. Ads violating intellectual property rights.

4. Ads involving banned goods or services.

5. Ads including unauthorized use of logos or trademarks.

6. Ads promoting illegal activities or harmful behavior.

 

Tasweer has the right to delete any advertisement that violates policies and take necessary action without liability.
